【Special Notice】
This combined version contains two parts: Part I "Terms of Service" and Part II "Privacy Policy", along with regional/state-specific clauses and compliance appendices. The Terms of Service and Privacy Policy constitute integrated terms. In case of discrepancies between Chinese and English versions or conflicts between different jurisdictional clauses: for users in China, the Chinese version and "China-specific clauses" shall prevail; for users in the United States, the English version and their state-specific clauses shall prevail. Consumer inalienable rights are not limited by this agreement.

Part I: Terms of Service
Article 1 (Definitions)
- 1.1 "Platform/We" refers to "PomeloX" and its operating entities.
- 1.2 "User/You" refers to natural persons who register or use platform services (including guardian representation, school-verified student users, etc.).
- 1.3 "Services" refers to functions and activities provided online or offline by the platform, including AI Q&A, Wellbeing Plan, airport pickup & transportation, activity management, volunteer management, local discounts, marketplace/job matching, alumni network, etc.
- 1.4 "Third-party Service Providers" refers to external partners such as carriers, merchants, payment institutions, cloud services, communication services, volunteer organizations, etc.
- 1.5 "Applicable Law" refers to laws, regulations, and mandatory policies that are binding on users' locations and platform entities (including Chinese mainland law, US federal law, and state laws, etc.).
Article 2 (Service Scope and Nature)
2.1 The platform is an information and collaborative service provider and does not directly provide police, medical, and public safety services. In case of emergency danger, please prioritize contacting local emergency numbers (110/120/911).
2.2 Specific functions:
- AI Q&A: Provide study abroad guides, visa/course/housing information suggestions (for reference only, not legal/immigration/medical advice)
- Wellbeing Plan: Missing person emergency coordination, volunteer clue collection and liaison (no guarantee of recovery or specific results)
- Airport Pickup & Transportation: Free bus reservations, paid pickup/rideshare (provided by third-party carriers/drivers)
- Activity Management: Event publishing, registration management, check-in/check-out and QR code verification
- Volunteer Management: Check-in/out, hour tracking and certification (non-employment/labor relationship)
- Local Discounts: Merchant offers, points and redemption (subject to merchant rules)
- Marketplace/Job Matching: Information posting and chat matching (platform does not participate in transactions or provide guarantees)
- Alumni Network: Email verification, trusted referrals (does not constitute employment commitment)
2.3 The platform has the right to add, modify, or discontinue functions based on business and compliance needs, and will notify through app announcements/pop-ups/emails.
Article 3 (Registration and Eligibility)
- 3.1 You must be at least 14 years old to register independently; those under 14 must have guardian representation or provide explicit guardian consent (US law has additional restrictions for those under 13 under COPPA).
- 3.2 You should provide truthful, accurate, and complete registration information and keep it updated; hold a valid school email or referral code (if applicable).
- 3.3 You should properly safeguard your account and password and be responsible for all activities under your account. If you discover unusual use/security risks, you should immediately notify the platform.
Article 4 (User Conduct Standards)
4.1 You promise to comply with applicable laws and public order and morals, and not engage in the following behaviors:
- Publishing illegal, harmful, vulgar, defamatory, hateful, discriminatory, violent, harassing, or misleading content
- Infringing on others' intellectual property, privacy rights, portrait rights, trade secrets, or other legitimate rights
- Impersonating others or institutions, fabricating qualifications, or spreading rumors
- Conducting reverse engineering, bulk crawling, malicious scanning, bypassing technical measures, or interfering with systems
- Unauthorized commercial promotion, mass advertising, traffic diversion, or inappropriate group invitations
- Endangering activity venues, transportation or ride safety, violating public security and traffic management rules
- Violating export controls and sanctions
4.2 The platform may take measures including reminders, traffic limiting, removal, muting, banning, evidence preservation, and legal cooperation with regulatory authorities or law enforcement agencies based on security and compliance needs for content and accounts.
Article 12 (Dispute Resolution and Applicable Law)
- 12.1 Users in China: Governed by Chinese law, with jurisdiction by people's courts having jurisdiction in [China domestic entity domicile].
- 12.2 Users in the United States (including CA/NY/MO/MN/WA): Governed by your state of residence or California law (excluding conflict of laws rules). Except for small claims, disputes arising from these terms shall be submitted to JAMS/AAA for individual arbitration and waive class action/class arbitration.
- 12.3 Arbitration Opt-out: You may opt out within 30 days of agreeing to these terms by sending an "Arbitration Opt-Out" email to dev@pomelo-x.com (with name, account, registered email/phone number, and clear opt-out statement).
- 12.4 If state law provides additional protection for consumer health data and other types of disputes (such as Washington state), such special provisions shall apply.
Part II: Privacy Policy
Article 1 (General Provisions and Scope)
- 1.1 This policy applies to your use of all platform functions. We may act as "personal information processor/controller" or "service provider/processor" and share or entrust processing with third-party service providers within the minimum necessary scope.
- 1.2 We follow the principles of legality, legitimacy, necessity, good faith, and transparency, minimize the processing of sensitive personal information, and implement differentiated protection.
Article 5 (Minor Protection)
- 5.1 Users in China: Those under 14 must have explicit guardian consent; appropriate protection is provided for those aged 14-18.
- 5.2 Users in the United States: We do not target services or targeted profiling at children under 13; if mistakenly collected, we will promptly delete and notify guardians (if feasible).
Article 7 (Cross-border Transfer and Overseas Recipients)
- 7.1 Data may be stored and processed in the United States or other regions.
- 7.2 Users in China: If providing personal information overseas, we will comply with PIPL and supporting rules (such as "standard contracts/certification/security assessment") and achieve compliance through individual explicit consent + recipient information and risk notification.
- 7.3 Overseas Recipient: Vita Global (as overseas collaborative partner, USA). Purpose: Service delivery, customer service/technical support, backup and security. Contact: info@chineseunion.org.
